for any sum or sums paid by the Assured to any other person or persons by reason of the Assured becoming legally liable, as owner of the Vessel, for any claim, demand, damages and/or expenses, where such liability is in consequence of any of the following matters or things and arises from an accident or occurrence during the period of this insurance:1.1 failure or default of the Assured their agents or servants other than Master Officer or crew member1.2.3 undertake towage or salvage services under a contract previously arranged by the Assured and/or Owners and/or Managers and/or Charterers without the prior written agreement of the Underwriters.  This Clause 4 shall not exclude customary towage in connection with loading and   中国人民财产保险股份有限公司内河船舶保险条款（2009版） 总   则第一条 本保险合同由保险条款、投保单、保险单、保险凭证以及批单组成。凡涉及本保险合同的约定，均应采用书面形式。第二条 本保险合同中的船舶是指在中华人民共和国合法登记注册、从事内河航行的船舶，包括船体、船舶检验证书簿上载明的机器、设备和助航仪器。第三条 本保险分为全损险和一切险，保险人按保险合同列明的承保险别承担保险责任。 保险责任第四条 全损险   　在保险期间内，由于下列原因造成保险船舶的全损，保险人按照本保险合同的约定负责赔偿：（一）六级以上(含六级)大风、地震、雷击、崖崩、滑坡、泥石流、冰凌；（二）火灾、爆炸；（三）搁浅、触礁、碰撞及触碰；（四）由于上述一至三项灾害或事故引起的倾覆、沉没；（五）船舶失踪。第五条 一切险在保险期间内，由于第四条列举的五项原因造成保险船舶的全损或部分损失及产生的下列责任和费用，保险人按照本保险合同的约定负责赔偿：    （一）碰撞及触碰责任保险船舶在可航水域与其它船舶、码头、港口设施、船闸、航标发生接触性的碰撞或触碰，造成上述被碰撞物体的直接财产损失或引起的费用，包括被碰撞船舶上所载货物的直接损失，依照中华人民共和国法律应当由被保险人承担的侵权经济赔偿责任，保险人负责赔偿。但本保险对此种碰撞、触碰责任仅负责被保险人应承担赔偿金额的四分之三，但最高不超过责任限额。本碰撞及触碰责任的赔偿限额为保险船舶的保险金额，在保险期间内累计赔偿额达到责任限额时，本项保险责任终止。在被保险人征得保险人书面同意并加交保险费后，本项保险责任恢复。（二）救助与施救本保险负责赔偿被保险人在发生保险事故时，为保险船舶的航行安全而支出的必要合理费用，包括为确定保险事故的性质、程度而支出的检验、估价的合理费用，以及为执行保险人的特别通知而支出的费用，保险人在保险船舶损失赔偿之外另行支付。保险人对本项规定的费用的支付，凡涉及船货共同安全的，以获救保险船舶的价值占获救船、货、运费的总价值的比例为限，且不超过保险金额。 除外责任第六条 在保险期间内存在下述情况，自下述情况发生之日起保险人对任何原因产生的责任、损失和费用不负责赔偿： （一）船舶不适航（不适拖），包括保险船舶的人员配备不当、技术状态、航行区域、用途不符合航行（拖航）规定或货物装载不妥。定期险和航次险分别按以下方法进行界定和处理： 1.定期险：除非被保险人能证明其不知道或没有理由知道这种不适航情况的存在，否则保险人不负任何赔偿责任，并有权解除保险合同，但保险人可自事故发生之日起按日比例退还已交的未到期的保险费。2.航次险：只要保险船舶开航时不适航，保险人不负任何赔偿责任并有权解除保险合同，不退还保险费。（二）被保险人、船舶所有人、船舶经营人及其代表、船长利用保险船舶进行违法犯罪活动，保险人有权解除保险合同，且不退还保险费。第七条 在保险期间内因下列原因造成或引起的损失、责任和费用，保险人不负责赔偿：（一）保险船舶自然磨损、锈蚀、腐烂； （二）保险船舶在航行中引起水浪击打或拍打他船或他物造成他船、他物的损失；座浅（因落潮或装载而引起船舶吸底而坐落于水底的现象）和擦浅（在正常航行水域，因航道淤积或水位变化导致船底与河床长期频繁摩擦）； （三）被保险人、船舶所有人、船舶经营人及其代表、船长的故意行为，但施救和救助行为不在此列；  （四）战争、军事行为、扣押、骚乱、罢工、哄抢和政府征用、没收；（五）任何核物质、核材料或核放射、核试验；（六）行政行为或司法行为。第八条 在保险期间内，对下列损失、责任和费用保险人不负责赔偿：（一）保险船舶正常的维修、油漆；机器发生故障造成本身的损失及费用；（二）舵、螺旋桨、桅、锚、锚链、橹及子船的单独损失；  （三）拖带责任以及由拖带行为引起的被拖船的任何责任、损失和费用，但被拖船为保险船舶的碰撞责任、损失和费用不在此列； （四）任何污染、防止污染或清理污染；（五）清除任何残骸和清理港口、码头、航道、可航水域；（六）任何人员伤亡；（七）水产养殖及设施、捕捞设施、水下设施、电缆、桥或在建桥梁及其相关设施；（八）保险船舶上所载的货物；（九）被保险人或任何其他人的间接损失和间接费用，包括因保险事故造成的停航、停业而引起的船员工资、运费、租金、给养、燃料等费用和利益损失，任何物体的延迟或丧失使用的损失，水上经济活动损失，沿岸工农业和旅游业的损失等。第九条 其它未列明在保险责任范围内的损失、责任和费用，保险人也不负责赔偿。 保险期间第十条 保险期间按以下规则确定：（一）定期险：保险期间最长为一年，起止日期以船舶保险单载明的时间为准。（二）航次险：保险期间按保险单载明的为准，保险责任起止时间按下述规则确定：自起航港解缆或起锚时开始，至目的港抛锚或系缆时终止。除另有书面约定外，保险期间最多不超过30天。 保险金额和保险价值第十一条 保险船舶的保险价值由合同双方根据保险船舶的市场重置价进行约定，保险金额不得超过保险价值。保险金额与保险价值以保险单载明的为准。保险金额低于保险价值的，视为不足额保险。 投保人、被保险人义务第十二条 投保人应如实填写投保单并回答保险人提出的询问。在保险期间内，投保人或被保险人应对其公司、保险船舶发生变化影响保险人利益的事件如实告知，对于保险船舶出售、光船出租、变更航行区域或保险船舶所有人、管理人、经营人、名称、技术状况和用途的改变、被征购征用，应事先书面通知保险人，经保险人同意并办理批改手续后，保险合同继续有效。否则自上述情况出现时保险合同自动解除。第十三条 投保人或被保险人应在保险合同成立时交纳保险费。保险费交付前发生的保险事故，保险人不承担赔偿责任。（一）定期险：除保险合同另有书面约定外，投保人或被保险人在保险合同成立时应一次交清保险费。（二）航次险：保险合同成立时，投保人或被保险人应一次交清保险费。第十四条 被保险人及其代表应当严格遵守港航监督部门制定的各项安全航行规则和制度，做好保险船舶的管理、检验和维修，确保保险船舶的适航性。若被保险人及其代表未严格遵守港航监督部门制定的各项安全航行规则和制度，或未做好保险船舶的管理、检验和维修，或未能确保保险船舶的适航性违反本款规定，保险合同自动解除。 第十五条 被保险人一经获悉保险船舶发生保险事故，应在48小时内通知保险人，并采取合理措施避免或减少损失，被保险人收到保险人有关采取防止或者减少损失的合理措施的特别通知后，应按保险人通知的要求处理。否则，保险人对于因此而扩大的损失进行合理扣减。第十六条 被保险人与有关方面确定保险船舶应承担的责任和费用时，须事先征得保险人书面同意。 赔偿处理第十七条 被保险人索赔时，应及时按案件处理需要提供有效单证，包括但不限于保险单正本、索赔函、海事签证、航行日志、轮机日志、内河交通事故报告、船舶法定证书、运输合同载货记录、事故调查结论、事故调解书、裁决书、损失清单及被保险人所能提供的与确认保险事故的性质、原因、损失程度等有关的其他证明和资料。被保险人向本公司请求赔偿并提供理赔所需资料后，本公司在60天内进行核定。对属于保险责任的，本公司在与被保险人达成赔偿或给付保险金的协议后10天内，履行赔偿义务。第十八条 在保险期间内，保险船舶发生保险事故引起的责任、损失和费用，保险人按以下规定赔偿：     （一）全损险     保险船舶发生全损时按保险金额赔偿，但保险金额高于保险价值的，赔偿金额不超过保险价值。   （二）一切险1.船舶全损：按第十八条第一项规定计算赔偿。     2.船舶部分损失：（1）足额保险：按实际发生的损失赔偿，且以保险金额为限。（2）不足额保险：按保险金额与保险价值的比例乘以实际损失计算赔偿。3.救助和施救： 保险金额大于或等于保险船舶获救价值时，按实际发生的费用赔偿；保险金额小于保险船舶获救价值时，按保险金额与保险船舶获救价值的比例赔偿。4.部分损失累计的赔偿金额达到保险金额时，保险责任即行终止。经保险人书面同意，被保险人补交保险费后，则不受此限。第十九条 被保险人收到第三方的损害赔偿请求时，应立即通知保险人。未经保险人书面同意，被保险人自行对第三方做出的任何承诺、拒绝、出价、约定、付款或赔偿，保险人有权重新核定，并对不属于保险人责任或不合理的损失和费用拒绝赔偿。。第二十条 保险船舶从预计到达目的港之日起，超过两个月尚未得到其消息视为失踪，按实际全损处理。第二十一条 除全损、触碰和碰撞责任外，保险人对每次事故的赔款均按保险单约定的免赔额或免赔率进行相应扣减。在不足额保险时，先计算保险金额与保险价值的比例，再扣除免赔额或免赔率。第二十二条 保险船舶遭受全损或部分损失后的残余，由保险双方协商处理。第二十三条 保险船舶发生保险责任范围内的损失应由第三者负责赔偿的，被保险人应向第三者索赔。如果第三者不予支付，被保险人应采取必要措施保护诉讼时效；保险人根据被保险人提出的书面赔偿请求，按照保险合同予以赔偿，同时被保险人必须依法将向第三者追偿的权利转让给保险人，并协助保险人向第三者追偿。由于被保险人的过失造成保险人代位求偿权益受到损害，保险人可相应扣减赔款。第二十四条 被保险人向保险人请求给付保险金的诉讼时效期间为2年，自其知道或者应当知道保险事故发生之日起计算。 争议处理及法律适用第二十五条 因履行本保险合同发生的争议，由当事人协商解决。协商不成的，提交保险单载明的仲裁机构仲裁；保险单未载明仲裁机构且争议发生后未达成仲裁协议的，依法向中华人民共和国有管辖权的海事法院起诉。本保险合同（包括本合同的任何附加险）的解释、执行、争议处理适用中华人民共和国法律。 附   则第二十六条 保险责任开始前，投保人要求解除保险合同的，应当向保险人支付相当于保险费10%的退保手续费，保险人退还剩余部分保险费。保险责任开始后，投保人要求解除保险合同的，自通知保险人之日起，保险合同解除，保险人按短期费率计收保险责任开始之日起至合同解除之日止期间的保险费，并退还剩余部分保险费。保险人也可提前15日向投保人发出解约通知书解除本保险合同，保险人按短期费率计收保险责任开始之日起至合同解除之日的保险费，并退还剩余部分保险费。 附录：短期费率表保险期间（个月）12345678910-12按年费率（%）304050607080859095100注：不足一月的部分按一个月计收。
